BY USING CHANIA.TAXI IN ANY WAY YOU HAVE AGREED TO EACH AND EVERY ONE OF THE FOLLOWING TERMS & CONDITIONS:
1. In General
The following General Terms and Conditions of Use of the Platform and Service (hereinafter referred to as the «General Terms of Use» or «General Terms») have been established by the Sole proprietorship under the name “KYRIAKOS PROUKAKIS”, headquartered in 2 Ag. Triadas Sq. – Korakies Akrotiriou, Chania, Crete, Greece with VAT no: EL 055717512 (hereinafter referred to as ” the “Company” or “We” or “us” or “our”), a fully registered and legally operating as a taxi owner that provides taxi services in the area of Chania, Crete, Greece with GTNO license number 1042Ε81000379101.
The Company operates and manages this web platform (“the Site” or “chania.taxi”) under through which tourists/travelers (hereinafter “Travelers”, “You”, “Yours”, “User”) can make a booking of a transport service (hereinafter referred as “Transport Services” or “Transfer”), operated either by the vehicles owned by the Company or by collaborative partners of ours (hereinafter the “Partners”) through which they receive by Us, acting as intermediary between You and the Partners, notifications and requests for the provision of Transport Services to You (hereinafter “Service”). All of our Partners are legally licensed and operating taxi and/or private vehicle (rental car with chauffer service and/or travel agency’s vehicles) entities in Crete, Greece.
These website’s terms and conditions of use (“Terms”) govern your use of this Website (“the Site” or “chania.taxi”), so please read them carefully. By using, viewing, transmitting, caching, storing or otherwise utilizing the Site, the information, services or functions offered in or by the Site and/or the contents of the Site in any way, you have agreed to each and all of the terms and conditions set forth below.
If, by any way, you do not accept these Terms then you must stop using this Website immediately.
2. Terms of use of chania.taxi
a) chania.taxi provides information regarding taxi and transfers services (prices, availability, etc.) in the area of Chania as well as everywhere in Crete, along with a range of other information, in order to assist the User to make a Transfer reservation, through its carefully selected network of partners. It is owned, operated and managed personally by Kyriakos Proukakis, a licensed taxi owner, fully registered and legally operating as a taxi services provider in the area of Chania, Crete, Greece.
b) The Site is not charging to the customer any kind of fee for the provided information or reservation services. Any charge, fee or fare that concerns the provided taxi/transfer services to the User is charged directly to the customer by the actual providers of these taxi/transfer services that is therefore held totally responsible for issuing any type of receipt or invoice for the services they provide to the User.
c) The content published in this Site is intended for information and reservation purposes only. While the Site makes all reasonable efforts to verify that the information presented on chania.taxi is accurate and current, the Site makes no express or implied warranties about the information, the services, or any other element of the Site.
d) No illegal or unauthorized suppliers of any kind of transfer services are Partners of chania.taxi. Any individual partner that is assigned by us to conduct any taxi/transfer service reserved by you through the website is a professional, fully registered and legally operating taxi or transfer provider under the Greek legislation. They are held legally liable to comply at all times with all the necessary legal licenses and documentation provided by the Greek State (that allow them to provide taxi or transfer services under a fee in the area of Chania or Crete) but we are not to be held liable if those licenses stop to be in effect for any reason and we are not explicitly notified by our Partners for that.
Additionally, any liabilities or claims raised by you that derives from any action caused by those third party Partners of the taxi/transfer services (such as illegal acts and practices, injuries or deaths due to an accident, misbehave, etc.) occurred during the taxi/transfer services as well as any compensation of damage of any kind that the customer is entitled to claim, lies solely to these Partners and not to chania.taxi.
The Site shall not accept any liability for any loss or damage you may suffer or incur as a result of the service provided to you by a third-party Partner or the incorrect processing of your reservation details by a third-party Partner but will provide their company’s information to you as long as you wish to legally proceed to any liability claims from them.
3. Booking policy of chania.taxi
a) Any reservation requests send by the User through the Site are considered (by the company) as “Under Process” Reservations, even if an online payment was made by the user during the reservation request.
Shortly after you make your reservation request, you will receive an automated email acknowledging the reception of your request from us. This should NOT be considered (by you) as an instant Confirmation of your reservation.
Each reservation request has to be Confirmed (by the company) by a booking Confirmation Email and/or a booking Confirmation text (SMS or WhatsApp) that you will receive, in order to be considered “Confirmed / Active” (hereby referred as “Confirmed Booking”).
Our effort is to send this Confirmation Email as soon as possible after the request was made but this might take some time as availability has to be manually checked.
We may also reject your reservation request as it is subject to availability of vehicles for the given route and/or time & date.
The “Reservation STATUS” of each request is stated clearly on the follow-up email’s title as well as at RESERVATION DETAILS section of the email itself.
PLEASE check your Spam folder as well, apart from your main Inbox.
b) The user is solely responsible for the accuracy of all the provided details regarding his/her reservation request (contact details and transfer details). Make sure to fill in correctly the Reservation Form as also to check the accuracy of the details of your booking when you receive our Confirmation Email.
c) There are 2 ways of payment for the user while making a reservation
CASH payment (must be in cash exclusively as not all vehicles are equipped with card readers) which allows a free reservation to be placed. In this case no prepayment is required, no cancellation fees apply and the payment is done directly to the driver upon conclusion of the transfer.
ONLINE Payment (by credit/debit card) which allows the user to pay in advance for a transfer. A handling fee surcharge of 5% as well as cancellation fees applies in this case. Please read carefully our Online Payment policy & our Cancellation fees policy.
The online payment process is hosted and executed solely by STRIPE in STRIPE’s servers, therefore all the information provided by the User during the payment (email address, card details, etc.) is solely processed and held by STRIPE.
We do not handle or store, in any way, any of the payment information in our servers, therefore we will not be held liable for any damages or losses the user might incurs due to credit card’s information details security breaches, etc.
d) chania.taxi and its partners will not be held responsible in the occasion that prior to or during your transfer various unexpected events occur beyond our control (including but not limited to: roads blocked due to natural phenomenon of a higher power, events like protest demonstrations, road accidents, extreme adverse driving and traffic conditions, unexpected mechanical problems and damages of our or our partners’ vehicles, possible strikes of the taxi industry declared by the local Taxi Unions, etc. ) which will prevent us to provide our services partially or totally, consistently and as have been agreed as well as also for any damage caused to you by the failure of arriving on time at your destination.
We are committing though that we will notify you immediately and, if possible, in advance of time for our inability to provide you with our services due to these unforeseen events and that we will provide all possible information and assistance in order to help you getting alternative modes of transportation, when and if possible.
e) Complimentary Waiting time policy
Your Driver will be waiting for You at the pickup place at the time that is scheduled in the Confirmed Booking, subject to the provisions of this Complementary Waiting Time Policy and Extra Waiting Time Policy, so You must make sure that You show up in time, to avoid as being marked as a non-show where all the Terms of the users’ No – Show Policy apply.
The Company offers the following complimentary waiting times, depending on the type of Transfer booked:
Arrival Airport pickups: 60 minutes after your flight has actually landed at the airport (incorporating into that approximately 30 minutes of an average passport control and luggage delivery time required after landing)
Port pickups: 30 minutes after your ferry has actually arrived at the port
Other locations’ pickups: 20 minutes from the scheduled/requested pickup time.
If you do not show up in time at the designated/requested pickup point within the time provisions as mentioned above in the Complementary Waiting Time Policy without previously notify us about a possible delay from your side, then despite our efforts to directly contact you on the telephone number you provided during your reservation, we reserve the right to consider that as a “Customer’s NO SHOW” case and we are entitled to Cancel your reservation without any refund.
f) In case that the you cannot find your driver at the pickup place at the time that is scheduled in the Confirmed Booking, you must immediately contact us via phone at this number +30 697 750 9258 and let us know about it. The sooner we know about it, the better we can handle the situation. If we fail to provide an alternative transportation solution withing the time provisions as mentioned above in the Complementary Waiting Time Policy, then you have the right to consider that as a “Drivers’ NO SHOW” and unilaterally cancel the transfer in which case we will refund you 100% of the transfers price.
4. Online Payments policy (Privacy policy & surcharge)
a) The online payment process is hosted by STRIPE and executed solely in STRIPE’s servers, therefore all the information provided by the User during the payment (email address, card number, name details, CVC number, etc.) is solely processed and held by STRIPE (learn more here).
We do not handle or store, in any way, any of the payment information in our servers, therefore we will not be held liable for any damages or losses the user might incurs due to any security issues related to credit card’s information details, etc.
b) When the Online Payment method is selected by the user at step #3 of the reservation form, a surcharge handling fee of 5% is being applied to the transfer’s quoted price as Stripe’s fee for the process of the payment, any possible refunds’ fees, etc.
c) When you will submit the reservation and as long as the Online Payment has been chosen, you will be redirected to a checkout page hosted by Stripe. Upon successfully completing the payment, you will receive an email titled as “Your chania.taxi receipt” as proof of a successful payment (this email is automatically generated by Stripe). Make sure that the email address you will provide during payment is correct.
5. Cancellation Policy fees (for prepaid transfers) & Refunds
In order to Cancel your booking, you must send an email to info@chania.taxi Please mention the Reservation number of your booking and the name under which the reservation was made.
The time & date of the Cancellation request email in relation to the time & date of the Confirmed transfer (subject to cancellation & refund) defines the Cancellation fees applied according to the following:
1. Cancellation by the user (the customer) prior to the transfer
At Chania Taxi, we understand that travel plans may change. Our cancellation policy is as follows:
- Cancellations made more than 3 days before the scheduled transfer will incur a 20% cancellation fee of the total booking amount.
- Cancellations made up to 3 days of the scheduled transfer, including same-day cancellations, are non-refundable, and the full booking amount will be charged.
For any modifications or inquiries regarding your booking, please contact us as soon as possible.
2. Cancellation by the Company
a. No cancellation fee will be applied if the Company REJECTS your reservation request due to Unavailability (100% full refund will be issued back to your card).
b. No cancellation fee will be applied if we fail for any reason beyond our control (read 3.d paragraph of the Booking policy) to provide a vehicle for your Confirmed Booking (100% of the amount paid will be refunded to your card) as well as in case of a “Driver’s No Show” as described at paragraph F of the Booking policy.
The amount to be refunded will be equal to the specific failed transfer and not to the whole reservation’s amount if previous transfers in this reservation has been already provided by us. For example, if we provide the first transfer on a roundtrip reservation but fail to provide the second transfer, we will refund only the amount that corresponds to the 2nd transfer.
6. Privacy Policy of chania.taxi
a) chania.taxi could require various types of information any time you contact us and/or whenever you make a reservation for a taxi/transfer service.
b) The personal information that you provide (such as your name, your mobile telephone number and your email address) as well as the information concerning your taxi/transfer request (such as the flight details, pick up and drop off points, date and time of the transfer, etc.) will be used by the Site in order to:
Respond to any questions, requests or information requested by you.
Confirm your transfer reservation request by sending you a confirmation email or a confirmation text via SMS or WhatsApp.
Contact you for any reason that concerns your confirmed taxi/transfer reservation (when additional information needed, etc.) as also to inform you about any necessary changes or cancellation of your reservation in case of acts of God, mechanical problems/failures, political conditions, strikes declared by the local Taxi Unions, etc. that may prevent us from delivering your requested taxi/transfer service.
Receive feedback reports and reviews from you and conduct surveys regarding the Site and the provided taxi/transfer services, in order to improve our providing services.
Send to you (with your agreement) newsfeed, promo material and discount offers and coupons about services you may use in the future.
chania.taxi DOES NOT share (*), rent or sell to anyone any of the personal or other type of information that you may provide us.
(*) Only the necessary information concerning your taxi/transfer reservation will be shared with the partners (local and legally authorized taxi and travel service providers) of chania.taxi, in order to fulfil your reservation and deliver to you the requested services.
The Site may use/publish some data drawn by customer’s feedback, surveys, etc., only for promotional purposes of the Site but without any disclosure of personal information details of yours such as your name, telephone number, email address.
c) The online payment process is hosted by STRIPE and executed solely in STRIPE’s servers, therefore all the information provided by the User during the payment (email address, card number, name details, CVC number, etc.) is solely processed and held by STRIPE (learn more here).
We do not handle or store, in any way, any of the payment information in our servers, therefore we will not be held liable for any damages or losses the user might incurs due to any security issues (related to credit card’s information details), etc.
e) chania.taxi uses cookies in order to gather technical information from your computer’s Web browser, which may include your IP Address, operating system, web browser software, screen resolution, etc. This helps us to monitor and improve our website’s performance delivered to you. You may refuse the use of cookies by setting accordingly your web browser’s preferences.
7. Legal notice
All transactions made through our site are governed and protected by international and European law that regulates issues relating to electronic commerce (Directive 2000/31/EC) and by the Greek Law (Law 2251/1994) on Consumer Protection, as amended and currently in force).
Our company and the user commit to solve with goodwill any dispute that may arise during the performance of the convention of the organized trip, transport, tour and other services. If the amicable settlement is not possible, then the jurisdiction belongs to the Court of Chania.
